1. Who we are
1.1 The Trixy Workshop is sold by Bonny Snowdon Academy Ltd, a company registered in England and Wales under company number 13500111, whose registered office is at Unit 115, Accounts By Simply, 40 Gracechurch Street, London EC3V 0BT (“we”, “us”, “our”). [Our VAT number is [ ].]
1.2 You can contact us at [support@bonnysnowdonacademy.com]. If we need to contact you we will use the email address you gave us when you ordered.
1.3 These Terms and Conditions apply to your purchase of a ticket to the Trixy Workshop and, where you buy it, to the ebook described at clause 9. They do not apply to Ignite membership, which is governed by separate terms.
2. These Terms and Conditions
2.1 These are the terms on which we sell the Trixy Workshop to you. Please read them before you place your order. By placing your order you confirm that you accept them.
2.2 You are buying as a consumer if you are an individual buying wholly or mainly for your personal use. Some of the rights in these Terms and Conditions apply only to consumers, and we say so where that is the case.
3. Your order and our contract
3.1 Placing an order is an offer to buy. Our acceptance takes place when we send you an order confirmation email, at which point a contract comes into existence between you and us.
3.2 If we cannot accept your order we will tell you and will not charge you.
4. What you are buying
4.1 The Trixy Workshop is a five-day online coloured pencil drawing workshop, delivered as online video lessons running to approximately eight hours in total, together with any accompanying reference images and downloadable materials we make available.
4.2 The subject of the Workshop is Trixy, a rescued spaniel.
4.3 The five lessons are released on 21, 22, 23, 24 and 25 September 2026, or on such other dates as are published on the sales page at the time you order. We will tell you if those dates change.
4.4 As soon as we have accepted your order we will send you your order confirmation email, and we will then give you access to your account and send you your welcome materials, which include a preparation guide, an introductory video, reference images and other resources. Please see clause 10, because receiving those materials affects your right to change your mind.
4.5 You will need a device capable of streaming video, a broadband internet connection, and an up-to-date web browser. We are not responsible for a failure to access the Workshop caused by your equipment or your internet connection.
4.6 Images on the sales page are for illustration. Drawing outcomes depend on your own materials and technique and we do not promise any particular result.
5. How long you can access the Workshop
5.1 Once released, each lesson and each item of accompanying material remains available to you in your account for so long as we continue to operate the platform on which the Workshop is hosted, and in any event for a minimum of 24 months from the date of your purchase.
5.2 If we decide to stop operating the platform, or to withdraw the Workshop from it, we will give you at least three months’ notice by email, so that you can download any materials made available for download.
5.3 Where our marketing describes access to the Workshop as “lifetime access”, that phrase means access on the basis set out in clauses 5.1 and 5.2 and nothing more.
5.4 Access is personal to you. It is not transferable and cannot be sold, gifted or shared.
6. Price and payment
6.1 The price of a standard ticket is £8.00. The price of an Ignite member ticket is £3.00. Ignite member tickets are available only to existing Ignite members whose membership is current at the date of order.
6.2 The price you pay is the price displayed at the point of order. The price displayed is the total you will pay; there are no compulsory extra charges, fees or delivery costs on top of it.
6.3 We take payment at the time you place your order.
6.4 It is always possible that a price is wrongly stated. If the correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
7. Additional charges
7.1 We will not add any charge to your order that you have not expressly agreed to. Any optional extra is presented as an unticked option which you must select yourself. Nothing is added to your order automatically.
8. The charitable donation
8.1 We are a commercial participator within the meaning of section 58(1) of the Charities Act 1992. We are not a charity.
8.2 The following statement applies to your ticket.
Standard ticket:
“£4.00 from the £8.00 price of each standard Trixy Workshop ticket will be paid to Moorview Rescue Limited (working name The Yorkshire Rescue), registered charity number 1155095. The £4.00 is calculated on the full ticket price and is not reduced by payment processing charges, platform fees, or any other cost borne by Bonny Snowdon Academy Ltd.”
Ignite member ticket:
“£3.00 from the £3.00 member price of each Ignite member Trixy Workshop ticket will be paid to Moorview Rescue Limited (working name The Yorkshire Rescue), registered charity number 1155095. That is the whole of the price you pay. Bonny Snowdon Academy Ltd meets any VAT and transaction costs on that sale from its own resources.”
8.3 The donation is made by us, out of the price you pay. You are not making a donation to the charity yourself; you are buying a ticket from us. That means the donation is not a gift by you, Gift Aid does not apply to it, and you cannot claim tax relief on it. No part of the price you pay is held by us on trust for the charity.
8.4 Where you receive a full refund, whether under clause 10 or otherwise, no donation arises in respect of your order. Your refund is always the whole of the price you paid, including the part that would have gone to the charity. We never deduct the donation from a refund and we never ask you to recover it from the charity.
8.5 As between us and the charity, a refunded order is deducted from the next sum we account for to the charity. If we have already paid the donation over and there is nothing left to deduct it from, we bear that cost ourselves. Either way it makes no difference to you.
8.6 If your standard ticket is refunded in part rather than in full, the donation is not reduced and is paid to the charity in full.
8.7 The whole of the price of an Ignite member ticket is paid to the charity. We therefore do not make partial refunds on Ignite member tickets. Where a refund is due on an Ignite member ticket it is a refund of the whole £3.00.
8.8 We have no control over how the charity applies the money it receives.
9. The ebook
9.1 After you have paid for your ticket we may offer you the opportunity to buy an optional digital ebook, [title], at a price of £17.00. Buying it is entirely optional. It is never added to your order unless you select it, and nothing is pre-ticked.
9.2 The following statement applies to the ebook:
“This ebook is sold by Bonny Snowdon Academy Ltd. No part of the price is paid to Moorview Rescue Limited or to any other charity.”
9.3 The ebook is a separate purchase from your ticket and forms a separate contract between you and us. Clauses 10 to 19 apply to it as they apply to the Workshop, and references to the Workshop are to be read as references to the ebook where the context requires.
9.4 The ebook is supplied as an immediate download. As with the Workshop, you will be asked to confirm that you want it straight away and that you understand you will lose your right to change your mind once it has been made available to you. Clause 10 explains this.
10. Your right to change your mind
10.1 If you are a consumer you have a legal right to change your mind within 14 days of the day we send you the order confirmation email, and to receive a refund. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This clause 10 sets out the conditions, the time limit and the procedure for exercising that right, and the circumstances in which you lose it.
10.2 The Workshop is digital content supplied online rather than on a disc or other physical item. Where digital content is supplied in that way, the right to change your mind comes to an end once we begin supplying it to you, but only if, before we begin, you have expressly asked us to start straight away and have separately acknowledged that by doing so you will lose that right.
10.3 You give us that request and that acknowledgement by ticking the box at checkout. The box is not ticked for you and you must tick it yourself. Because we begin supplying the Workshop immediately, we cannot complete your order unless you tick it.
10.4 If you buy through the checkout, we begin supplying the Workshop as soon as we have sent you your order confirmation email, by giving you access to your account and sending you the welcome materials described at clause 4.4. Your right to change your mind ends at that point. We will confirm your request and your acknowledgement to you in that order confirmation email, and we will send it to you before we give you access.
10.5 If for any reason we have not yet begun supplying the Workshop to you, your right to change your mind continues until we do, or until the end of the 14-day period if that is earlier.
10.6 To change your mind under clause 10.1, email us at [support@bonnysnowdonacademy.com]
10.7 We will refund you by the method you used to pay, within 14 days of the day you tell us. We will not charge you a fee for making the refund. Clauses 8.4 to 8.7 explain how the charitable donation is dealt with on a refund; it never reduces what you get back.
10.8 Nothing in this clause affects your rights if there is something wrong with the Workshop. Those rights are set out at clause 11 and are not given up by ticking the box.
11. If there is something wrong with the Workshop
11.1 If you are a consumer, we must supply digital content that is of satisfactory quality, fit for any purpose you made known to us, and as described. These are your rights under the Consumer Rights Act 2015 and nothing in these Terms and Conditions affects them.
11.2 If the Workshop is faulty or misdescribed you are entitled to ask us to repair or replace it, and if that is not possible or we do not do it within a reasonable time, to a price reduction.
11.3 Please contact us at [support@bonnysnowdonacademy.com] and we will deal with your complaint under clause 18.
12. What you may and may not do with the Workshop
12.1 We give you a personal, non-exclusive, non-transferable licence to access and view the Workshop, and to use the materials, for your own private and non-commercial purposes.
12.2 You may draw from the reference images for your own practice, and you may share your own finished drawings, including on social media.
12.3 You may not: share your login details or allow anyone else to use your access; record, download other than where we expressly provide a download, copy, screenshot for redistribution, upload or otherwise reproduce any lesson; make the Workshop or any part of it available to anyone else, whether or not for payment; or use the Workshop or the materials to teach, run a class, or create a competing course.
12.4 All intellectual property rights in the Workshop, the lessons, the reference images and the materials belong to us or our licensors. Nothing in these Terms and Conditions transfers any of those rights to you.
12.5 The names and logos of Bonny Snowdon, the Bonny Snowdon Academy, The Yorkshire Rescue and Moorview Rescue Limited are protected. Nothing in these Terms and Conditions gives you any right to use them.
12.6 If you breach clause 12.3 we may suspend or end your access without refund, and we may take further action.
13. Our responsibility for loss or damage
13.1 If we fail to comply with these Terms and Conditions we are responsible for loss or damage you suffer that is a foreseeable result of our breach, but we are not responsible for any loss or damage that is not foreseeable.
13.2 We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the digital content we supply.
13.3 If you are a consumer, we are not liable for business losses. If you use the Workshop for any commercial or business purpose we will have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
14. Events outside our control
14.1 We are not responsible for delays or failures caused by an event outside our control. If one occurs we will contact you as soon as possible and take steps to minimise the delay. If the delay is substantial you may contact us to end the contract and receive a refund for any part of the Workshop you have paid for but not received.
15. Changes
15.1 We may make minor changes to the Workshop to reflect changes in law or to make technical adjustments and improvements. These will not affect your use of it.
15.2 If we need to make a more significant change, we will tell you before we do and you may then contact us to end the contract and receive a refund for anything you have paid for but not received.
15.3 We may amend these Terms and Conditions from time to time. The terms that apply to your order are the terms in force at the date you placed it.
16. Ending the contract
16.1 We may end the contract at any time by writing to you if you breach clause 12.3, or if you do not make a payment when it is due and you still do not pay within 14 days of us reminding you.
17. Your personal information
17.1 We use your personal information as set out in our privacy notice at [https://bonnysnowdonacademy.com/privacy-policy/].
17.2 We keep a record of your order, including the date and time at which you ticked the box referred to at clause 10.3, for as long as we need it to deal with any question about your purchase.
17.3 We will share with the charity only aggregate figures about sales and the amounts due to it. We will not share your personal details with the charity unless you give your separate, explicit consent, for example by opting in to hear from it.
18. Complaints
18.1 If you are unhappy with the Workshop or with our service, please contact us at [support@bonnysnowdonacademy.com]. We will acknowledge your complaint within five working days and respond substantively within 20 working days.
18.2 If your complaint concerns the charitable fundraising aspect of the Workshop, you may also complain to the Fundraising Regulator.
19. Other important terms
19.1 We may transfer our rights and obligations under these Terms and Conditions to another organisation. We will tell you in writing if we do, and we will make sure the transfer does not affect your rights.
19.2 You may only transfer your rights or obligations to another person if we agree in writing.
19.3 This contract is between you and us. No other person has any right to enforce any of its terms, and the Contracts (Rights of Third Parties) Act 1999 does not apply. For the avoidance of doubt, the charity has no rights against you and you have no rights against the charity under this contract.
19.4 Each of these paragraphs operates separately. If a court decides that any of them is unlawful, the remainder will remain in full force.
19.5 If we do not insist that you do something you are required to do, or if we delay in taking steps against you, that will not prevent us doing so later.
19.6 These Terms and Conditions are governed by English law and you can bring legal proceedings in the English courts. If you live in Scotland you can bring proceedings in either the Scottish or the English courts, and if you live in Northern Ireland, in either the Northern Irish or the English courts.
